A commercial yacht is a yacht available for charter, allowing guests to rent it for a luxury experience. These yachts are used for generating income and can host paying passengers. A private yacht, however, is owned by an individual or company and is not available for charter, offering exclusive use for the owner and their guests.

A Company Security Officer (CSO) coordinates security activities for both the company and its ships, ensuring security systems are maintained and audited. The Ship Security Officer (SSO), often the ship’s master, is responsible for implementing the security plan on the vessel. Both roles require proper training and knowledge of security systems. Regular drills and exercises are conducted to maintain the security plan’s effectiveness, including performing drills every three months or whenever there is a significant crew change.

The International Convention for the Safety of Life at Sea (SOLAS) sets the minimum safety standards for ship construction, equipment, and operation. Flag states ensure ships under their flag meet these requirements, and port state control allows inspections if compliance is questioned. For commercial yachts, SOLAS mandates life-saving equipment, safe manning, and specific construction standards to ensure survivability at sea.

The International Safety Management (ISM) Code is a set of safety standards for yachts above 500 GT, regardless of flag state. Created by the International Maritime Organization (IMO), it focuses on ensuring the safety of passengers, crew, and the environment through strict operational guidelines and safety protocols.

The Mini ISM refers to a safety management system for luxury charter yachts under 500 GT, based on the Large Yacht Code (LY3). This system ensures compliance with safety standards for construction, equipment, and personnel. While originally required for commercial yachts, private yachts are now also adopting Mini ISM for better safety, fewer surprises, and more predictable budgets.

When a yacht enters a foreign port, it must often provide essential information, including confirmation of a valid ISSC, details about its current security level, security measures taken at previous ports, and ship-to-ship activity procedures. This information ensures compliance with international maritime security regulations and port state requirements.

The International Ship and Port Facility Security Code (ISPS Code) was adopted by the IMO on December 12, 2002, and has two parts: Part A, which includes mandatory requirements, and Part B, which offers detailed guidance. By July 1, 2004, contracting governments were required to implement the mandatory aspects of the code while considering the guidance.

In the UK, the Transport Security Division (TRANSEC) of the Department for Transport (DfT) oversees the implementation of the ISPS Code for port facilities and passenger ships. The Maritime and Coastguard Agency (MCA) handles security for cargo and freight vessels.

The ISPS Code outlines responsibilities for governments, companies, and ships, including setting security levels, creating Declarations of Security, conducting security assessments, and ensuring proper training and drills. It also mandates ship security plans, the master’s authority, and the appointment of designated security officers. Compliance with SOLAS amendments, such as ship security alert systems and continuous synopsis records, is also required.

The ISPS Code applies to passenger ships, cargo ships (including commercial yachts) over 500 gross tonnage, and mobile offshore drilling units (MODUs) on international voyages. It also covers port facilities serving these vessels. However, warships, naval auxiliaries, or ships owned or operated by a government for non-commercial purposes are exempt.
